Terms of Use
The agreement behind the tools.
These Terms govern your access to websites, progressive web applications, subscriptions, AI-assisted tools, and related services provided by Circle The People LLC.
1. Agreement
By accessing or using the Services, you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy. If you use the Services for an organization, you represent that you can bind it. If you do not agree, do not use the Services.
2. Eligibility and accounts
You must be at least 13 and legally able to form a binding agreement. If you are below the age of majority where you live, a parent or guardian must authorize your use. Provide accurate information, protect access credentials and devices, and promptly report suspected unauthorized use. Product-specific device limits and access rules may apply.
3. Subscriptions, payments, and cancellation
Prices, billing intervals, trials, usage allowances, and included features are shown before purchase. Subscriptions renew automatically until canceled. Stripe processes payments. You authorize recurring charges and are responsible for applicable taxes. You may cancel through the provided subscription-management method; cancellation ordinarily takes effect at the end of the paid period. Except where law requires otherwise or a specific offer states differently, fees already paid are non-refundable.
4. The Services and changes
We may improve, replace, limit, suspend, or discontinue features. We aim to give reasonable notice of material changes but may act immediately for security, legal, provider, or reliability reasons. Features may require compatible devices, permissions, internet access, or third-party services.
5. AI-assisted output
AI output may be inaccurate, incomplete, offensive, or unsuitable. Review it before relying on, publishing, or acting on it. The Services do not provide medical, legal, financial, therapeutic, emergency, or other licensed professional advice and do not guarantee outcomes. You remain responsible for your decisions, communications, and use of output.
6. Your content
You retain ownership of content you submit. You grant Circle a limited, worldwide license to host, reproduce, transmit, transform, and process that content only as reasonably needed to provide, secure, support, and improve the Services. You represent that you have the rights and permissions necessary to submit the content and that doing so complies with law and our Acceptable Use Policy.
7. Circle property
The Services, software, branding, designs, documentation, and other Circle materials are owned by Circle or its licensors and protected by law. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose. They do not transfer intellectual-property ownership.
8. Third-party services
The Services may depend on or link to third parties such as payment, hosting, AI, mapping, browser, or device providers. Their terms and privacy practices may apply. Circle is not responsible for a third party’s independent service.
9. Suspension and termination
You may stop using the Services at any time. We may restrict or terminate access for nonpayment, material breach, fraud, abuse, security risk, unlawful conduct, or conduct that threatens users or the Services. Provisions that by nature should survive termination—including ownership, disclaimers, liability limits, and dispute terms—will survive.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” CIRCLE DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT OUTPUT WILL BE ACCURATE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIRCLE AND ITS AFFILIATES, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY. CIRCLE’S AGGREGATE LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID CIRCLE FOR THE RELEVANT SERVICE DURING THE 12 MONTHS BEFORE THE EVENT. Some jurisdictions do not allow certain limitations, so they apply only to the extent permitted.
12. Indemnity
To the extent permitted by law, you will defend and indemnify Circle from claims, damages, and reasonable costs arising from your unlawful content, violation of these Terms, or misuse of the Services. This does not apply to the extent a claim results from Circle’s own conduct.
13. Governing law and disputes
Wyoming law governs these Terms, without regard to conflict-of-law rules. Before filing a claim, each party will make a good-faith effort for 30 days to resolve it informally through our private contact form. Unless applicable consumer law requires otherwise, courts located in Sheridan County, Wyoming will have exclusive jurisdiction. Nothing here limits non-waivable consumer rights.
14. General terms
These Terms and incorporated policies are the agreement concerning the Services. If one provision is unenforceable, the rest remains effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; Circle may assign them as part of a restructuring or transfer of the Services.
